ORDINANCE ESTABLISHING A SIX MONTH MORATORIUM ON DATA CENTER APPLICATIONS
FOR DEVELOPMENT IN WOODFORD COUNTY, IL
WHEREAS Woodford County, Illinois has been granted authority to regulate and restrict
location and use of structures pursuant to 55 ILCS 5/5-12001 ET. Seq. and to amend its' zoning
regulations pursuant to 55 ILCS 5/5-12014, and Woodford County Zoning Ordinance Chapter 154 of
the county code; and
WHEREAS, the Woodford County Boatd is aware of the desite to develop Data Centers of varying
sizes and capacities throughout the State of Illinois; and

an adjourned meeting thereof begun and held in the Woodford County Board Room in the City of Eureka, in
said County, on the third Tuesday in July, AD 2026, same being the 21st day of said month.

Board met and was called to order by Vice Chairman John Krug.
Vice Chairman Krug began the meeting by leading all present in a moment of silence and the Pledge of
Allegiance.
Roll call by the Clerk. Present: James Baumann, Denise Durst, Zachary Ferris, Autum Jones, John
Krug, David Meinhold, Don Rood Jr., Jonathan Schertz, Tim Wilcoxen, and Tim Worner. Absent: Randy Barth,
excused; Nick Miller, resigned; Chuck Nagel, excused; Blake Parsons, excused; and Richard Reeb, excused.
Also present was County Clerk Dawn Kupfer.

Clerk Kupfer presented and read the Certificate of Giving Notice for this meeting.

ptocess. Her request is she hopes the county can see not double charging for a permit is the right thing to do
since it’s already been permitted once. She doesn’t think it is fair to be charged again.

Ms. Teresa Gauger, 428 E Second Street, El Paso, Illinois spoke to the Finance
Committee about the Proposed El Paso TIF District and handed out a chart she prepared
showing the Woodford County Diverted Taxes for the proposed TIF District. She stated
she was here to ask for support in an appointment as the Resident Representative on a
Joint Review Board for the proposed TIF District in El Paso. Ms. Gauger said it is the 8
Members of the taxing body which 1 of the Board Members will be chosen to fill the
spot, who chooses the resident from the community. She said she has resided in El Paso
all her life and has attended City Council Meetings regularly for the last 7 years. Ms.
Gauger stated she was willing to serve because she felt the Joint Review Board plays a
critical oversite roll and residence deserves a voice at the table when decisions are being
made that can affect our taxing bodies for the next 23 years. She said her goal is simpl …

Sheriff Smith gave the Committee an update on some projects saying the front block work and flashing is complete. He said the HVAC Valve replacement for the Public Safety Building is ongoing, the loading dock is complete for the most part. Sheriff said we shortened the wall as part of the project because over the course of the last 25 years it has been backed into multiple times by semi-trucks trying to unload. He said they were waiting to put an end cap on the wall, and the project would be completed. Sheriff said Maintenance is working on collecting quotes for the South Parking Lot Repairs which will be available by next month’s meeting.

Vice Chaitman Ferris exptessed how important it is for the County to come up with a plan for Data
Centers. Wilcoxen asked if any legislation will be coming down from the state. Ferris stated there are
currently no state laws for data centers. There are other counties and municipalities with data center
ordinances. Parsons mentioned the state will allow governing counties to come up with an outline for this
for now, but that could change. The County currently does not have anything that prohibits it. A
temporary moratorium might be considered. Wilcoxen mentioned concerns for electtical and water
consumption. Parsons explained the County’s Long Range Plan that would be considered. The
possibilities of a moratorium wete discussed.

extinguishers inspected at a lower cost to the County. Discussion was had on the possibility of
receiving a bid for the entire County’s fire extinguishers inspected with the suggestion of
forwarding the discussion to the Public Safety Committee.
Baumann asked for further explanation about a claim for $6,426.19 for shop work on a totaled
tractor. Mr. Moore said the claim was for a mowing tractor which had rolled over last fall and
had been taken to Heritage Tractor, they had ordered a new cab for the tractor, and later it was
