DISCUSSION
Discussion of City-Owned Property
City Manager Jason Davis led the discussion of City-owned properties, stating that the purpose
of the workshop was to review options so that Council could direct staff on which properties to
research further and return in November 2026 for a formal vote at a regular meeting. The City
Manager noted that staff had research to conduct regarding checks for reverter clauses and deed
restrictions on certain parcels. The property spreadsheet presented was drawn from notes from
February 2026 and from a system-generated listing. The City Manager clarified for the record

City Council - Special Meeting
Council weighs DeBerry request to change millage vote, which could void 4.5600 rate
The Fort Walton Beach City Council holds a special meeting on Council Member Gloria DeBerry's request to change her vote on the 2026-27 millage rate, which was adopted 5-2 on September 29, 2026 at 4.5600 mills. The City Attorney advises that if her vote changes, the 4.5600 rate loses its required super-majority and a different rate would have to be adopted, but that Florida law may not authorize amending an already adopted and submitted rate. Staff asks the Council to decide whether to grant or deny the request.
- Request by Council Member Gloria DeBerry to change her vote on the 2026-27 millage rate of 4.5600 mills, adopted 5-2 on September 29, 2026
- City Attorney: changing the vote would invalidate the 4.5600 rate because it would no longer have a super-majority
- Millage of 4.5600 exceeds the rollback rate of 4.2546, requiring a super-majority under section 200.065, Florida Statutes
- City Attorney cites Attorney General Opinion 86-100 and RONR 12th Edition sections 45:8 and 45:9 on changing votes
- Staff notes possible consequences including noncompliance, withholding or forfeiture of state revenue sharing funds
budgettaxesmillage-ratecity-councilprocedurefort-walton-beach
✓ Decided: Fort Walton Beach City Council adjourns special meeting without action on millage rate
The City Council failed to approve the meeting agenda and subsequently voted to adjourn. No action was taken regarding a request to change a previous vote on the millage rate.
- Approval of agenda denied (2-3)
- Motion to move to adjournment adopted (5-1)

Fort Walton Beach council weighs letting member change millage vote after 5-2 adoption
The Fort Walton Beach City Council holds a special meeting on October 6, 2026 to consider Council Member Gloria DeBerry's request to change her vote on the 2026-27 millage rate of 4.5600 mills, which was adopted 5-2 on September 29, 2026. The City Attorney advises that if her vote changes, the 4.5600 rate would no longer have the super-majority support required under Florida law, and a different rate would have to be adopted. The attorney also raises a legal question about whether state law allows amending a millage rate after it was adopted and submitted to the Okaloosa County Property Appraiser and the Florida Department of Revenue. Staff asks the Council to decide whether to grant or deny the request.
- Request by Council Member Gloria DeBerry to change her vote on the 2026-27 millage rate of 4.5600 mills, adopted 5-2 on September 29, 2026
- City Attorney memo: a changed vote would remove the super-majority needed for 4.5600 mills, requiring a different rate
- Legal question raised on whether Florida law permits amending a millage rate after final adoption and submission
- Okaloosa County Property Appraiser indicated it will certify the tax roll on October 2, 2026; Florida Department of Revenue is not taking a position
- Possible consequences cited: noncompliance notice, withholding or escrow, and forfeiture of state revenue sharing funds

✓ Decided: City Council adjourns special meeting without changing millage rate vote
The City Council failed to approve the meeting agenda and subsequently voted to move directly to adjournment. No action was taken on a request to change a previous vote regarding the millage rate.
- Approval of agenda failed (2-3)
- Motion to move to adjournment adopted (5-1)

✓ Decided: CRA adopts FY 2026-27 budget with $325K increase, 5-1
The Community Redevelopment Agency adopted CRA Resolution 2026-1, approving its Fiscal Year 2026-27 budget, on a 5-1 vote with Payne Walker dissenting. The budget was built on a 4.608 millage estimate and projects roughly $911,000 returned to the CRA fund balance, which sits at about $3 million. Discussion covered the difference between the proposed rate (about $218,573 to the CRA) and the rollback rate (about $49,168), and staff said the budget would be adjusted if the Council adopted a lower millage. The only other vote was approval of the agenda.
- Adopted CRA Resolution 2026-1, the FY 2026-27 CRA budget (5-1; Walker opposed)
- Approved the agenda as presented (unanimous)
