The Chesapeake Beach Town Council will hold a public hearing and vote on Ordinance O-26-14 to prohibit data centers in all zoning districts. RE: Home Occupation exemption for business that are under state or federal regulation
The Council is considering amending §209 -11 (CC) regarding home occupations to
accommodate a resident seeking a home business. Since the Planning & Zoning Commission
originally omitted the word “regulated” in its proposal for §290 -11 (CC)(1)(e) & (2)(e), t he
Council can align the text with The Commission’s original intent by removing this word without
requiring a second recommendation from The Commission. To allow state or federally regulated
home occupations, the Town Council simply needs to strike “regulated” from §290-11 (CC)(1)(e)
& (2)(e), as shown below.

ADU Adoption discussion - Ms. Franklin stated that the Planning Commission has
completed its review on Accessory Dwelling Units (ADUs.) The ordinance is before
the Council for final review before introduction in order to comply with the State's
October 1 deadline. Ms. Franklin addressed the conditions and standards for conditional
and special exception uses for accessory dwelling units and Dr. Okpodu addressed the
provisions related to the allocation of water and sewer capacity. The Council asked
questions, expressed concerns, and made a number of revisions. The general consensus
of the Council was for the Town Attomey to incorporate the revisions into the ordinance
for introduction at the August Town meeting.

1. Chesapeake Village Sidewalk to Beach Elementary School (BES) The SHA grant offer to complete
the 100% design for this project was declined in May and the project is being re -worked by staff.
2. Safe Crossings/Pedestrian Safety throughout town: Crossing projects were placed under study by
SHA in the Fall of 2025 with an expected 120-day completion period. Laura has requested follow up
by Town Staff. See below:

by the town. The FIDS topic has been discussed in closed Town Council meetings in 2025 and in
Planning Commission meetings in 2026. Laura has expressed concerns about all of the above to the
Mayor, the Town Administrator, the Zoning Administrator, and Council members and has requested a
closed legal session …

AMENDING THE TOWN CODE, CHAPTER 290, “ZONING,”, ARTICLE

WHEREAS, Chesapeake Beach (the “Town”) is a municipal corporation of the State of
Maryland, organized and operating in accordance with Article XI -E of the Constitution of
Maryland; and
WHEREAS, pursuant to Md. Code Ann., Local Gov’t Art., § 5- 213, the Town has the
authority to provide reasonable zoning regulations subject to the referendum of the voters at

provided with a letter of recommendation from the Planning Commission
recommending data centers be prohibited in all zones within the Town of Chesapeake
Beach. Currently, data centers are permitted within the MC- Marine Commercial
district. The Commission is recommending the Council amend the Table to remove
Item # 57 "Data Centers" and add a new row for "data centers" to a section titled
"Expressly Prohibited Uses" with a NP- Not Permitted, in all zones. The Council was
provided with a draft ordinance with amendments to review. Ms. Franklin was available

Green Team
Green Team plans food forest, trail signs, and $4,400 in spending
The Chesapeake Beach Green Team is coordinating upcoming environmental events, including storm water practices and erosion control planting, and is advancing plans for a food forest at the 26th Street Pocket Park. The team is also allocating remaining FY26 funds for trail signage, rain barrels, educational books, and gift certificates, and will prioritize arborist recommendations at the next meeting.

Public Meeting being held tonight at 6:15 regarding issuance of Municipal Bond for
$6.1m for funding the Waterpark renovation(s).
General discussion regarding current work ongoing – demolition has not begun;
discussions/meetings being held to include permitting with State and County.
Discussions also included anticipated capacity limits (current park has a capacity
of 1363 ppl but rarely exceeded 900 at peak times; targeting closer to max of 750
with new park); number of lifeguards required (based on anticipated capacity
limits); number of bathrooms (water closets) required; increasing deck space, etc.
