[Music Playing] >> The Board of County Commissioners acts as a quasi-judicial body when it hears requests for rezoning and conditional use permits. Applicants must provide competent, substantial evidence establishing facts or expert witness opinion testimony showing that the request meets the zoning code and comprehensive plan criteria. Opponents must also testify as to facts or provide expert testimony – whether they like or dislike a request is not competent evidence. If a commissioner has had communications regarding a rezoning or conditional use permit request before the board, the Commissioner must disclose the subject of the communication and the identity of the person, group, or entity with whom the communication took place before the board takes action on the request. Likewise if a commissioner has made a site visit inspection or investigation the Commissioner must disclose that fact before the board takes action on the request. Each applicant is allowed a total of 15 minutes to present the request unless time is extended by the board. The applicant may reserve any portion of the 15 minutes for rebuttal. Other speakers are allowed five minutes to speak. Speakers may not pass their time to someone else in order to give that person more time to speak. >> I would like to recognize Bishop Martin Clark with Truth Revealed international ministries to give us the invocation for today. So I had an easy month and an easy week this week. I also wanted to remark on a comment that was made about somebody 's going to die on A1A. Just so everybody knows, two people have died on A1A, one last year and one this year, and it had absolutely nothing to do with any business that is running in this town. So one was at a crosswalk and it was just a tragic accident and it was an elderly man and I think, did his dog die too? The dog did not die. And the second one was a bicyclist that was improperly crossing A1A and was struck by a truck and that was also a tragic day. It actually happened right in front of the Nautilus business, which I believe was the woman that was commenting . So someone, people have died and it doesn't have anything to do with any businesses and I just kind of wanted to say that. So thank you. Julie. Nothing to report. All right. Thank you. This is all about the or did the homeowners, was that the homeowners fence, it's not clear, but it just shows me a little bit I'm concerned that we do all this stuff with permitting, we do all this stuff with, you know, you're supposed to have a plot plan, and I don't know who screwed that up, but the county was very, very nice, and they sold that piece of property so the guy would still have, I think, three feet so he could go beside his screen room. So that was a nice thing, I think, but how did we get into that situation in the first place? I don't know if there's any corrective action that we need to look at what we're doing with permitting, but either the county screwed up and put the fence in the wrong place, the homeowner assumed that's where it was, and then the homeowner pulled a screen room permit, didn't pull his own survey, and so he went into the easement. So just trying to find out why that happened and why we had to, although the county made what? It made $332 by selling them that little plot, so that was revenue. So I just didn't know if anybody wanted to look at that and figure out why that happened. You want to get through all of them and answer? I could answer this maybe really fast. Okay, cool. This is a lift station in, it's in Indian Harbor Beach, but it's a county facility, and so Indian Harbor Beach would have issued the permit. Aye. So do they need to get... But we're working with the homeowner. We don't want them to have to take down fence …
