Good afternoon Kathy and Dave.
| had our managing architect Nick Lobosco review the renderings vs. the Village Code. Below is his response. It’s lengthy,
but is necessary for the record given our findings.
Based on my review of the provided documents and applicable code sections it appears the applicant is intentionally
designing all three buildings to comply with zoning height restrictions. So i would agree with the village clerk and
inspectors comments below.
Code Sections:
1. Zoning 205 Attachment 4 Schedule B Area and Bulk Regulations
a. District CBD allows max building height of 4 stories and 50 feet.
2. Zoning 205-5 Definitions:
a. Building Height - confirms height is based on the mean finished grade to highest point of building or
structure.
3. Zoning 205-26 —- Height Exceptions
a. Paraphrasing - Height limit can be exceeded no more than 5 feet at non-occupied features such pas
parapets or cornices.
b. Paraphrasing—
i. features should only be erected to such height as is necessary to accomplish their intended
purpose.
ii. Aggregate coverage shall not occupy more than 10% of the roof area.
iii. No signage to be placed on or within the height exception area.

AGREEMENT
This Agreement is made on the ist day of June, 2026, by and between the VILLAGE OF
BALLSTON SPA, a municipal corporation with offices located at 66 Front Street, Ballston Spa, New York,
12020, hereinafter referred to as the "Village" and the NATIONAL BOTTLE MUSEUM, a NY not for profit
organization with an address of 76 Milton Avenue, Ballston Spa, NY 12020, hereinafter referred to as
“Organization.”
WHEREAS, the Village of Ballston Spa is interested in and dedicated to the improvement and
enrichment of the quality of life for the citizens of the Village, through the sponsorship of activities provided
by the Organization, including but not limited to consulting services, programs for adults and children,
house the Village Visitors Center, provide brochures, and keep Village visitor statistic; and
WHEREAS, the Village deems it to be in the best interests of the health and welfare of the
community to have the activities and services provided by the Organization; and
WHEREAS, the Organization would be unable to continue to provide the programming without the
financial support of the communities it serves.
NOW, THEREFORE, IT IS AGREED, the Village and the Organization specifically agree as
follows;
1. Term: The Term of this Agreement shall run from June 1, 2026 to May 31, 2027.

Doug,
As an accompaniment to Part 2, Environmental Assessment Form regarding Section 5, an additional
assessment of potential impacts of the project on flood conditions has been completed. This letter is an update
to the March 2025 correspondence and is based on the most recent site plan
The project , located on the Flood Insurance Rate Map (FIRM) panel FM36091C0438, proposes to have one new
building located in the 1% annual exceedance interval ( 100 yr flood zone) and the 0.2% annual exceedance
interval (500 yr Flood zone). While the project site does have an established floodway along Gordon Creek, no
existing or proposed development will be located in that area.
The proposed project is adjacent to the flood flow and located on the upstream edge of the flood zone. The
development will maintain any existing drainage paths and the placement of fill will not have any adverse
impact to flood conditions or alter flood flow patterns during a 1% storm event of greater.

As you know, Tannery Commons is a proposed residential development located at 125 Bath Street in the
Village of Ballston Spa, NY. This site was previously proposed to be mixed-use, with apartments, retail
and office space, but that concept has recently changed to residential only.
In February 2025, GPI prepared a Traffic Impact Study for the site under its previous mixed-use
configuration. This study was reviewed on behalf of the Village by Creighton Manning (CM), who
provided traffic-related comments in a memorandum dated June 30, 2025. This memo also incorporated
comments made by CM in a 6/10/25 preliminary review.
For reference, the development information for the previous configuration (assumed in the 2025 traffic
impact study) and the current configuration are as follows:

I.
Introduction
The proposed project consists of the construction of three (3) apartment buildings on the west
side of Bath Street, north of Gordon Creek. The site is currently occupied by a vacant former
tannery building, which was most recently used as a commercial laundry facility until ceasing
operations in 2011.
Potable water and fire protection services will be provided through a new 6-inch water service
lateral connected to the Village of Ballston Spa water main located within Bath Street. Sanitary
sewer service will be provided through two new service connections to the existing Village of
Ballston Spa sanitary sewer mains in Bath Street.
II.
Project Description
The project proposes the construction of three (3) apartment buildings with associated access
drives, parking areas, landscaping and stormwater management. The buildings have a total of
168 residential units.
