Appearance Project Program
Chair LaCorte presented a draft Appearance Project Program Proposal for review.
Discussion focused on the scope of the program and the distinction between projects
occurring on public versus private property.
Staff advised that the Commission's enabling ordinance authorizes activities on public
property, including rights-of-way, parks, and green spaces, but does not provide
authority for projects on private property. Staff further explained that landscaping
activities within NCDOT rights-of-way are limited and that Commission efforts in those
areas would primarily involve cleanup and maintenance rather than planting or physical
enhancements.
The Commission reviewed the draft proposal and discussed the program's goal of
enhancing the appearance and visual character of the community through beautification
efforts and recognition programs. Members acknowledged that the proposal could be
revised as needed following Board review and implementation.
On a motion by Mr. Philpott, seconded by Vice-Chair Rogers, recommendation of the
Appearance Project Program proposal to the Board of Commissioners for approval was

UDO Text Amendment to § 152.130-135 Enforcement and Review
Planner Rebecca Brehmer reviewed that the Town Attorney had identified discrepancies
within the Town’s UDO §152.130–135, Enforcement and Review, regarding code enforcement
procedures and civil penalties. The proposed text amendment would address the
discrepancy and clarify the Town’s enforcement procedures and civil penalty provisions.
Planner Brehmer highlighted the following proposed changes:
• The 48-hour correction period would be removed, eliminating the requirement that
violations be corrected within 48 hours of a notice of violation. The administrator
would also be allowed to defer or suspend civil penalties when reasonable progress
is being made toward compliance.
• A $1,500 cap on civil penalties would be established, accruing at $50 per day. Planner
Brehmer explained that the cap was recommended based on case law to increase the
likelihood of penalty collection rather than penalties being reduced or dismissed due
to excessive amounts.

The proposed new definition would read: “a man -made structure of a barrier typically made of
wood, metal, chain link, vinyl, maso …
