2. Updates
E-bike Law - Councilman Garcia: EDAB provided input with the assistance
of an advocacy group. As a result, fine structure has been altered. Public hearing
set for Aug. 3.
Jeff G.: Some e-bike riders are reportedly going 40 MPH.
Councilman Garcia provided a description of speeds of different classes of e-
bikes. Some can have assists for hill climbing. The law is intended to deter
unsafe behavior. The state law subordinates to local communities.
Town Tavern- Councilman Garcia: An Erie County stormwater
management officer/trainer came out to review, per the request of the Town.
There was review and recommendation: an additional silt sock would be added.
Soil rill maintenance needs to be completed. Plant growth will be added to
stabilize the earth. Cattails have been found to be doing their job. There is no
sediment adversely impacting the waterway.
Jim D.: Can you forward any documented findings/report to CAB?
Councilman Garcia agreed to send to CAB. The contractor will execute the
recommended amendments.

River Lea Museum shore, East River Marsh, Beaver Island Beach, Woods Creek Kayak Launch.
The GI Historical Society River Lea Museum will be open for Paddles Up on July 25th. The GIHS
will be in the GI Parade on July 4th. June would like to stay on HPAB, looking for someone to be
chair. Alice would like to stay on the board.
Jodi Robinson:
Still looking for sign company for the cupola installment. Help in deciding on content for the
display. Decoration of cupola was noticed by board. Hoping planting would occur by fall.

The calendar team demonstrated and explained the project at the Town Board
workshop

The board was generally apprehensive for legal reasons. Most of the discussion
was in an executive session

Jenn: sticking points were around who’s going to run this and what’s allowed to
be posted on it legally, if the town is involved?

The discussion needed to be cut short due to time (at the Workshop)

Kristen: we should meet with Peter and spend some time preparing to make the
best use of our time with him

Rhonda: the town board was impressed with the product and was okay with the
subcommittee spending more time with Peter to find a path forward. You should
do a Zoom call with Peter to save time.

Wastewater Treatment Plant Emergency Project for the Digester
A motion was made by Councilman Garcia, seconded by Councilman Kilmer to adopt the
following Resolution of the Town of Grand Island declaring the necessity for an
emergency project and declaring such project to be a Type II action under SEQRA:
WHEREAS, the Town Board of the Town of Grand Island (the “Town”) has
determined that an emergency condition exists with respect to the digester at the
Town’s Wastewater Treatment Plant on Baseline Road (the “Digester”), arising from
degradation of the treatment process therein, which, if not promptly remediated, may
result in structural damage to the Digester and related environmental harm and may
imperil the life, health, safety, and property of the Town and the general public who rely
upon the Town’s wastewater system; and

Meeting called to order at : 7pm by Kurt Herrmann-Chair

Approve Minutes:
A motion was made by Herrman to accept the May minutes, seconded by
Fielder. Motion carried unanimously.

Business Discussed:
1)
E-Bike and E-Scooter Resolution – Grand Island Police Officer
Chris Pyc welcomes the new E-Bike and E-Scooter resolution and
said the danger is overriding the fun. However, he would like to
see the language changed in the resolution to include set fines.
Officer Pyc also requested a 30-day grace period in order to
educate the public. Several ideas for education were discussed
including National Night Out in August, the Island Dispatch, a
media advisory, and social media.
The Transportation Safety Advisory Board (TSAB) discussed the
amount of the set fines and decided on $50 for the 1st offense,
$250 for the second offense, and $500 for each subsequent
offense.
Kurt Herrmann made a motion to adopt Officer Pyc’s
recommendation, and the motion carried.

MINUTES
JUNE 4, 2026
MEMBERS PRESENT: Chairman Bob Mesmer, John Braddell,

Chairperson, Robert Mesmer, opened the meeting at 8:07 p.m. after an hour-long court
room delay, and introduced the members of the Zoning Board of Appeals and explained
the process.
NEW BUSINESS:
1) 2320 East River Road — Scott Butcher
This property is zoned R1C. The applicant is requesting a 7 ft. front yard
setback variance for the construction of a new covered front porch on an
existing single-family dwelling. The proposed setback with the new porch is
43 ft. from front lot line. Town Code §407 Attachment | Schedule | (R1C)
requires a 50 ft. front yard setback or 90 ft from center of R.O.W, whichever
is greater. In this case Town Schedule I, 50 ft. is greater making a 7 ft. front
yard setback variance necessary.
Appearing before the Board was Mr. Scott Butcher who resides at 2320
East River Road. Mr. Butcher was requesting to construct a new front
entrance to his home with a covered porch. He stated that the entrance
would be safer and have better curb appeal. The porch is proposed at 10 ft.
off the house, 3 of which are out of the setback making a 7 ft. variance
needed. Mr. Butcher also stated that he would address the watershed from
the new additions so not to affect the neighbors.
