Dover Council Weighs Annexation, Data Center Moratorium; No Decisions Published Yet

Over the past two weeks, Dover's City Council and several boards and commissions met to consider a range of items, including a proposed annexation and rezoning, a temporary moratorium on data centers, and multiple property-code appeals. Because minutes have not yet been published for any of these meetings, no final decisions are available. The following is a summary of what was on each agenda.

City Council

At its August 10 meeting, the City Council held a public hearing and final reading on the annexation and rezoning of 1.6390 acres at 102 Fox Hall Drive, from RS-1 to R-20. The agenda included adoption of Annexation Resolution No. 2026-09 and final reading of Rezoning Ordinance #2026-13. The council also considered appointments to the Planning Commission (Joan E. Denney and Donna Lee Williams) and the Dover Public Library Advisory Commission (Annie L. Scott).

On August 11, the Committee of the Whole discussed a proposed ordinance to adopt the 2024 ICC Codes, drafting a temporary moratorium for data centers, disbursement of Delaware Opioid Settlement Commission funding, potential changes to active recreation requirements for residential development, and a request for alley abandonment on Liberty Street.

Economic Development Committee

The Economic Development Committee meeting scheduled for August 11 was cancelled. The next meeting is set for September 15, 2026.

Construction and Property Maintenance Code Board of Appeals

On August 12, the board heard an appeal of a citation and fines for a violation of the 2009 International Property Maintenance Code at 253 Trafalgar Drive, specifically involving roof and drainage requirements under Section 304.7.

Planning Commission

At its August 17 meeting, the Planning Commission held a public hearing on a unified signage plan for Dover Commerce Park (350 Lafferty Lane, 32 sq ft freestanding sign) and considered a revised architectural review certificate for the West Entrance ADA Ramp at Legislative Hall (411 Legislative Avenue, approximately 160 feet long). The commission also discussed potential changes to active recreation requirements and held its annual officer elections.

Human Relations Commission

The August 18 meeting was routine, with committee reports and an open discussion period. No specific action items were listed beyond approving minutes from July 21.

Board of Adjustment

On August 19, the board held a public hearing on a variance request (V-26-04) for four RV lots at Kings Cliffe Manufactured Home Park, 1131 S. Bay Road. The property is zoned MH and partially in AEOZ Noise Zone A; the owner is Kings Cliffe MHP, LLC.

Police Advisory Board

On August 20, the board held a workshop covering citizen complaints, community concerns about policing, a FAQ flyer on motor vehicle crashes, a potential community meeting, and budget possibilities.

Code Board of Appeals

Also on August 20, the board heard an appeal of a citation and fees for a violation of Section 114-2(h) (Pruning and Removal) at 39 Periwinkle Court. The property owner, Indeira Reames, is contesting the enforcement action.

Historic District Commission

The commission reviewed two fence permits: a 6-foot black ornamental metal fence for Dover Fire Department Station #1 parking lots (103 S. Governors Ave., 116 S. Bradford St., and other parcels) and a 6-foot black-coated chain link fence for mechanical equipment at People's Church (46 S. Bradford St.).

Dover taskforce approves $197,600 in opioid prevention grants; annexation hearing set for Aug. 10

Dover's opioid prevention taskforce approved four grant projects totaling $197,600 and denied one proposal seeking $101,725, according to a July 24 meeting summary. The awards cover youth prevention, recovery engagement, and scholarship programs. Meeting minutes have not yet been published.

Opioid prevention grants

The Dover Taskforce reviewed five proposals for opioid use disorder initiatives on July 24. Four were approved:

• Carry Their Light Youth Opioid Prevention Media & Education Initiative — $50,000
• Downtown Dover Recovery Engagement & Stabilization Initiative (NorthNode Group Counseling) — $30,000
• The Healing Lens Project: Dover Youth Opioid Prevention & Community Awareness Initiative — $67,600
• House of Refuge Recovery Scholarship Program (Women of Value) — $50,000

A fifth proposal, the DE Recovery Advocacy Program by Firm Foundation requesting $101,725, was denied. The taskforce also approved prior meeting minutes. Full minutes are not yet published.

Annexation and rezoning of 102 Fox Hall Drive

The Planning Commission held a July 20 public hearing on annexation and rezoning request AX-26-03 for a 1.639-acre parcel at 102 Fox Hall Drive, currently zoned RS-1 and proposed for rezoning to R-20. City Council review is scheduled for Aug. 10, when the body will hold a public hearing and final reading on Annexation Resolution No. 2026-09 and Rezoning Ordinance #2026-13.

The same July 20 hearing included a street abandonment request (MI-26-08) for a segment of Liberty Street between Martin Luther King Jr. Boulevard North and South, approximately 319.45 feet and 0.44 acres. The Planning Commission also held its annual officer nominations and subcommittee appointments and considered a resolution honoring Mr. William L. Witham Jr. for his service on the commission.

City Council policy and ordinance items

On July 27, City Council discussed a proposed Dual Employment Policy recommended for approval by the Legislative, Finance, and Administration Committee. The body also considered the final reading of Proposed Ordinance #2026-05, amending Section 70-4 regarding playing games and throwing objects in public streets. The agenda included a quarterly review of the Capital Investment Plan covering April, May, and June; a quarterly revenue report as of June 30, 2026; and appointments to the Board of Adjustment, Code Board of Appeals, and Ethics Commission. Minutes are not yet published.

Property code appeals

Two boards heard property maintenance appeals in late July. On July 23, the Code Board of Appeals considered an appeal by Ying Chu of a citation and related fines issued under the 2009 International Property Maintenance Code for a violation at 172 Stoney Drive involving rental dwelling provisions.

On July 29, the Construction and Property Maintenance Code Board of Appeals took up appeals involving registration fees at 131 Orchard Avenue and 236 North Governors Avenue, and three citations tied to 838 Monroe Terrace. Property owners named in the agenda include Bobbie Hobbs, Lauren Good, and Michelle Staats. Outcomes are not yet recorded.

Other meetings

The Alderman's Court Ad Hoc Committee met July 21 to hear a presentation by Alderman's Court 40 Clerk Terri Conover, with public comment limited to three minutes. No actions were listed. The Human Relations Commission met the same day to approve minutes from its March 17, 2026 session and receive reports on assessment, community programs, school programs, by-laws, and finance; it set its next meeting for Oct. 20, 2026.

The Development Advisory Committee reviewed a Unified Comprehensive Signage Plan for Dover Commerce Park at 350 Lafferty Lane on July 29, including a proposed 32-square-foot, 9-foot-4-inch freestanding sign on the 19.74-acre campus. The July 28 Council Committee of the Whole meeting was cancelled.

Fox Hall Drive Annexation and Rezoning

The Development Advisory Committee met July 8 to review two applications forwarded to the Planning Commission for public hearings on July 20.

The first seeks annexation and rezoning of a 1.6390-acre parcel at 102 Fox Hall Drive from RS-1 to R-20 under Ordinance #2026-13. The second requests abandonment of a portion of Liberty Street — approximately 319.45 feet long and 0.4405 acres — between Martin Luther King Jr. Boulevard North and South.

Public comment was not accepted at the DAC meeting; comments will be allowed at the Planning Commission hearing. City Council review of the annexation request is scheduled for August 10.

City Council Zoning and Utility Items

City Council agendas from July 13 list a public hearing on Proposed Ordinance #2026-10, which would amend zoning regulations for manufacturing and industrial zones regarding Clean Hydrogen. The council was also set to consider corrected Electric, Water, and Wastewater Rates and Tariffs, a subdivision waiver request for lands of Wyoming LCC and Functional Properties LLC at Jefferson Terrace Extended, and Proposed Ordinance #2026-05 amending rules on throwing or kicking objects and playing games in public places.

Minutes for these meetings have not yet been published, so outcomes are not confirmed in the record.

Dual Employment Policy and Opioid Funding Item Removed

The Council Committee of the Whole agenda for July 14 listed a proposed Dual Employment Policy presented by HR Director Naomi Poole, with staff recommending approval. The agenda notes that the Delaware Opioid Settlement Commission Funding Disbursement item was removed from the Legislative, Finance, and Administration Committee agenda.

District reports from First, Second, Third, Fourth, and At-Large districts were also scheduled.

Board of Adjustment Variance Request

The Board of Adjustment held a public hearing July 15 on Variance Application #V-26-04 for 131 Rosemary Road, seeking to increase front-yard fence height to six feet. The board also adopted minutes from its June 17 meeting. The next Board of Adjustment meeting is scheduled for August 19 at 9:00 AM.

Vacant Building Registration Fee Appeals

The Construction and Property Maintenance Code Board of Appeals considered two appeals July 15 under the 2009 Property Maintenance Code: one from Denise Mittens for 558 North American Avenue Ext. and one from Lauren Good for 236 North Governors Avenue. Both involve vacant building registration fees.

Historic District Commission Reviews ADA Ramp

The Historic District Commission reviewed a revised application (HI-24-07) for a 160-foot ADA ramp at the west entrance of Legislative Hall, located at 411 Legislative Avenue, along with summaries of 2025 and 2026 applications and architectural certifications.
