AN ORDINANCE OF THE BOROUGH OF WYOMISSING, BERKS COUNTY,
PENNSYLVANIA, AMENDING THE BOROUGH OF WYOMISSING CODE OF
ORDINANCES, CHAPTER 27 ENTITLED “ZONING” TO ADD THE DEFINITION OF
“LANDSCAPE ARCHITECT”, TO IMPOSE UNIFORM, DETAILED REQUIREMENT FOR
LANDSCAPE PLANS AS PART OF PRELIMINARY AND FINAL LAND DEVELOPMENT
PLANS, AND REVISING THE EXISTING LANGUAGE FOR UNIFORMITY.
WHEREAS, the Pennsylvania Municipalities Planning Code, act of July 31, 1968, as
amended, 53 P.S. §§10101 et seq., enables a municipality through its zoning ordinance to regulate
the uses of property; and
WHEREAS, pursuant to the Municipalities Planning Code, the Borough of Wyomissing
enacted the Borough of Wyomissing Zoning Ordinance by Ordinance Number 1234 on February
11, 2003, which has been amended from time to time and is now known as Borough of
Wyomissing Zoning Ordinance of 2010, as amended (“Zoning Ordinance”); and
WHEREAS, the Zoning Ordinance is codified as Chapter 27 in the Borough of
Wyomissing Code of Ordinances; and
WHEREAS, Council for the Borough of Wyomissing desires to amend the Zoning
Ordinance, Chapter 27 of the Code of Ordinances to provide for detailed landscape plans as part
of the land development process in the Borough.
NOW THEREFORE BE IT ENACTED and ORDAINED by the Council of the Borough
of Wyomissing, Berks County, Pennsylvania by the authority of the same as follows:

APPLICATION:
Jonathan Scudder, owner of a property located at 1112 Fairview Ave. is requesting
a Variance from Section 424, “Area, Yard and Height Regulations” of the Borough
of Wyomissing Zoning Ordinance.
COMMENTS:
1. The property is located in the R-2 Suburban Residential District. The property
measures approximately 6534 sq ft and is non-conforming for the minimum
lot size of 12,000 sq ft for a single-family detached dwelling in that Zoning
District.
2. The property has a frontage along Fairview and Terrace Avenues (parallel
streets) and is bordered on both sides by other residential parcels.
3. The existing dwelling is located approximately 4.1 feet from the eastern side
property lines and approximately 11.89 feet from the western side property
line, and is therefore considered non-conforming for the minimum side yard
setback of 15’ per side required by Section 424 of the Zoning Ordinance.
4. Currently, the property has 980 sq ft of building coverage, which is roughly
15.1% of the total lot. This is conforming with the maximum permitted 25%
allowed by Section 424.
5. As an existing non-conforming building, Section 704.3 of the Zoning
Ordinance only allows additions to be constructed where all portions of the

The Borough of Wyomissing Recreation Board held their regular meeting in the Borough of
Wyomissing Council Chambers on the above date and time. Board Vice President Sally Donato called
the meeting to order with the following persons present: Board members Richard Weinhoffer, Pamela

In accordance with the Borough’s request, we have reviewed the above-referenced plan,
application, and supporting documents to determine compliance with the Borough’s Zoning,
Subdivision and Land Development, and Stormwater Management Ordinances. The property is
located in the Neighborhood Commercial (C-1) zoning district, and the Re-Development Area
Mixed Use Incentive (RAMUI) overlay district, Redevelopment Area 1 (RD1). The project is proposing
to construct a four-story, 30-unit apartment building, served by public utilities.

Tree Swallows
Nesting attempts made or underway in 12 boxes
First eggs laid on about May 5, several weeks after swallows returned
In Box#5, House Sparrows killed a Tree Swallow on an empty nest
As of most recent box check, no swallows had hatched but eggs were present
in 7 boxes
Carolina Chickadees
Nesting attempts made or underway in 3 boxes: #11, 12, 28
First eggs laid on about April 16
All 3 boxes had hatchlings present as of most recent check
House Sparrows
These non-native, aggressive competitors for nest boxes have attempted to nest
or have interfered with/killed native birds in 5 boxes so far this year.
Monitors have prevented reproduction of these birds in our boxes by a variety of
methods: piercing eggs, repeatedly removing the nests, and use of Van Ert traps.
House Wrens
These aggressive native songbirds have been heard in the vicinity of park but have
not (yet) evicted other birds from bo …
