Zoning Board of Appeals - Regular Meeting

✓ Decidido: ZBA approves area variance for 10x12 shed at 387 Delaware Avenue
The Zoning Board of Appeals held a public hearing and unanimously approved an area variance for Stephen Kitchen to install a 10-foot by 12-foot storage shed at 387 Delaware Avenue. The variance was needed because the shed would bring total accessory structure lot coverage to 7.6%, exceeding the 5% limit. The board found the variance request not substantial and that it would not harm the neighborhood. The board also accepted the minutes from the August 5, 2026 meeting with one abstention.
- Approved area variance 26-01000007 for a 10x12 shed at 387 Delaware Avenue (5-0)
- Accepted August 5, 2026 meeting minutes (4-0, Fitzsimons abstained)

1. To the community's feedback regarding the zoning proposal submitted by the
Planning Board, while we typically don't respond during the public comment periods of
our meetings, we have been listening carefully, not just to what you've been saying, but
to the concerns behind those comments. And rather than moving the plan forward as
currently drafted, the Town Board is taking a pause this summer as many residents have
asked to take additional time to review key elements of the proposal and to make
recommendations for moving forward this fall to respond to some of the themes that
we have heard. Thank you again to the hundreds of neighbors and residents who have

Supervisor VanLuven had five (5) announcements:
1. First, I want to give a quick update on the Zoning Code Update process. The Town Board has
listened to the community’s feedback regarding the zoning proposal submitted by the Planning

those comments. Rather than moving the plan forward as currently drafted, the Town Board will
take a pause this summer, as many residents have asked, to take additional time to review key
elements of the proposal and make recommendations for moving forward this fall to respond to
some of the themes we have heard. Thank you to the hundreds of neighbors and residents who
have attended meetings, submitt …
